'We Can' end domestic violence by winning over people

Bhubaneswar: The ‘We Can’ India campaign believes that Change Makers – people who actively encourage more positive attitudes and behaviour towards women in the communities they live and work in – have the potential to effect positive change by making people think differently about gender discrimination and violence against women, particularly domestic violence.

Speaking at the inauguration of the National Change Makers Assembly, held today to highlight and honour the efforts of 350,000 Change Makers (working in 170 districts in the 12 states of the country to affect people’s hearts and change the mindsets of entire communities towards domestic violence) Snehna Misra of ‘We Can’ Orissa said, “to end all violence against women there needs to be a new and collective understanding stemming from changed mindsets, altered behaviour and new beliefs about gender inequities and violence against women.”

This, explained, Anita Bharatiya of Nehru Yuva Kendra Sangathan, Rajasthan (a campaign ally), is the core endeavour of the ‘We Can’ campaign. “By providing information, alternate ideas and social values, campaign allies and the Change Makers they have enlisted enable men and women to realize they have potential to change their own lives and help them work towards ensuring violence-free lives for women. ‘We Can’, thus, serves as a trigger for a new societal consciousness.”

The ‘We Can’ India campaign is active in the 13 states of Andhra Pradesh, Rajasthan, Maharashtra, Uttar Pradesh, Jharkhand, Bihar, Tamil Nadu, Orissa, Gujarat, Madhya Pradesh, Bihar, Delhi and Uttaranchal. The campaign is currently being taken forward by over 300 organisations.

It is part of the larger six-year, six-country South Asia campaign to end all violence against women (‘We Can’) launched in 2004 in Bangladesh, Sri Lanka, Nepal, Pakistan and in 2006 in Afghanistan to unite men and women into an organized mass movement to transform existing power relations in society and within homes.

By 2011, ‘We Can’ will mobilize five million Change Makers in these six countries. Each of them will reach out to at least ten others so as to reach 50 million people in an effort to symbolically link up with the 50 million missing women in South Asia.

Sarat Mahapatra, Lokpal, Government of Orissa, K B Sign Deo, Minister for Urban Development and Public Enterprise, Government of Orissa and Tulasi Munda, tribal leader, extended their greetings and support to the campaign.

The National Change Makers Assembly that is to last till December 12 is packed with action-oriented outreach activities like cultural programmes and workshops to highlight campaign messages – the most significant of which is Equal Relationships are Violence Free.

‘We Can’ lays particular emphasis on domestic violence in each of the six countries. In India two-third women between the ages of 15 and 49 are subject to domestic violence, according to the UN Population Fund. According to a recent report by UNICEF, 69 million children witness violence within homes.

Change Maker Dhanam from Tamil Nadu says, “ We are all working to dispel the notion that domestic violence is ‘too personal’ or ‘private’ and unsuitable for mediation. By providing a public space to this issue and talking repeatedly about the issue we are making the issue a public concern. We are saying domestic violence is everybody’s business as it affects people adversely.”

“Campaign allies are working with a variety of groups like civil society groups, universities, medical practioneers, religious leaders, corporate bodies, housewives, teachers, lawyers, students and policy makers among other groups to raise awareness on the insidious problem of domestic violence, said Sneha Misra.

“The problem is intractable as it occurs within closed doors. But we are determined to bring it out into the open to find solutions and provide safe homes for women. It is sad that women face the most violence in the place that is meant to be a sanctuary for them,” she added.

Comment: It is wonderful to see that the unceasing campaign to bring domestic violence, (violence against women, specifically) has resulted in laws that cause agents of the patriarchal system, men as well as women, to sit up and think twice before subjecting women - specifically wives, daughters-in-law and daughters to different levels and types of violence. It is a indeed a great achievement of the women's movement that parts of the State, the judiciary and the police are recognising the systemic aspect of domestic violence and taking steps to curb it.

For every law that is made, we know that there are a percentage of citizens who will misuse it; at least we can say this for India. That does not mean that we should stop making laws.

I am skeptical about linkages, if any, that the ‘interesting’ comparative statistics of suicides by men and women may have with the incidence of domestic violence against women.

What the article is pointing out, is the need for sensitive people in society who are able to discern the human values behind every case and fight justly for the rights of each and every individual, woman or man. As is evident from the arguments above, we are still a long way away from that stage, and there is much work ahead for campaigners and ‘change makers’ such as those of We Can.

Finally, I reproduce a specific incident narrated by Tulika Saxena and published in ekduniya-gender (a discussion group on gender issues) to illustrate how domestic violence is blended into the fabric of this society:

Subject: Celebrity couple confesses to incidences of domestic violence

"I am writing this to bring your attention to an incidence, which I found highly objectionable. This is about a celebrity couple participating in the reality dance show "Nach Baliye-2" being aired on Star One, and the man inadvertently confessing incidences of violence within their relationship during the practice for the particular dance show.

On 11th December 2006, Star One telecasted the semi final round of Nach Baliye-2 in which three celebrity couples- Hussain and Tina, Yash and Gauri, Bakhtiyar and Tanaz had close competition, all trying to make to the finals. In this semi final round, Bakhtiyar and Tanaz (Jodi Number 10) lost their chance just by half point. This couple had been rated high throughout the series and obviously, they were shocked by the turn of the events as they were feeling confident that they will make through. Just to provide you with some background, Bakhtiyar, had earlier been pointed out by judges that he behaved aggressively. And although he was full of energy he was overconfident.

After listening to the results the couple were short of words, but suddenly Bakhtiyar started sharing his experiences of the hard work the couple had done to maintain their top position in the show. He had said that he had taken this show very seriously. He openly said that he had been violent with his wife Tanaz. He said that he used to publicly abuse her, as quoted by him, "Abusive in the sense that I used to do lot of gali galauz".

He said that when they used to practise lots of people used to turn around and wonder at his treatment of his wife. He said that Tanaz used to question, "Are other couples also treating their wives the same way that you do? "Is Yash treating Gauri the same way? Is Hussain treating Tina the same way?" Baktiyar stated that he used to get angry and irritated whenever his wife did mistakes in her dance step and whenever she took long to learn her steps. He said that he also became so violent once that while rehearsing the dance steps for one song "I am the Best"(the performance of this song was very much appreciated by the judges), where Tanaz missed (or may be did not do right) one step in which he had to lift her up that he just threw her down and she hurt her ankle. He proudly said that she still has a swollen ankle from that fall.

While he was sharing all this, his wife Tanaz was standing, silently crying. Then they both hugged each other and cried for their loss. All audiences and judges stood giving them a standing ovation.

I am shocked to hear all this. This was a clear case of domestic violence being openly narrated by a celebrity couple with such a pride (trying to show how sincere they were). It seemed as if nobody either among the judges, the participants, the audience and the management of the show had any objections. Is this the level of acceptance for domestic violence? Of course, it is clear, that this behaviour of Bakhtiyar is hardly an indicator of his sincerity for the show. Is he aware that his treatment towards his wife is punishable under the Domestic Violence Act? Moreover, I want to question the responsibility of media. Why have they aired this so casually as if this meant nothing? I am also wondering what the three judges of this show- Malayika, Kunal and Saroj Khan thought of it?"

Here, the author has rightly questioned the producers and the judges in failing to use that opportunity to point out to Bakhtiyar and Tanaz, that as celebrities in the show, the fact of his being abusive to his wife in public would have been a disqualifier for further participation, because violence is not acceptable or justifiable under any circumstances and for any reason.

Given that the show was aired, we have many witnesses and Mr.Bakhtiyar can easily end up behind bars, should a case be filed. However, I would prefer to recommend counseling as the first resort in such a case and hopefully the couple will look at this option to ensure an end to physical and non-physical violence in their relationship.

Also of concern is the fact that there are many Tanaz's around us. Women who think that it is okay to be shouted at, or 'thrown' when they miss a step...

May justice prevail for all. And let us all contribute towards this...

Comment: 4. Suicide Statistics of India
It is a common perception in India about men driving women to suicide. This is a major hoax created by Gender Feminists and Media Bias.
The suicide statistics in India are presented from World Health Organisation(WHO) sources. One out of ten people dying due to suicide in world is an Indian.

Comment: Yes!! You can Win ove People - the Citizens of the Country if the Laws created were logical and UnBiased.

Study the Laws implimented in other countries they treat both Man and Women Equally unlike in India where the Govt has been terrorosed and paid to impliment the biased laws giving powers to Women to BlackMail, Threaten and Extort Money by Misusing these Laws is this not Domestic Violence??

As Citizens of India, we should not and are not against the Laws of the Country, drafted towards the intention of stopping Injustice and Violence. What we request is to have these laws modified and amended to decrease the loop-holes and the Misuse of these laws. Our Suggestions would be:
i. There needs to be evidences provided / furnished before the Arrest of the Guilty.
ii. Incase proved to be a false allegation, misuse of the law the complainant and the parties supporting the misuse of the Law needs to be severely punished and fined automatically.
iii. Domestic Violence Act needs to be equally applicable on the Partners (including both Man and Women), Parents and Relatives. As is the case in all the Countries where there is this law. Why not in India?

What is IPC-498a ?


Cognizable – The accused can be arrested and jailed without warrant or investigation
Non-Bailable – The accused must appear in the court to request bail
Non-Compoundable – The complaint cannot be withdrawn by the petitioner



The accused are guilty with women one word, and the burden is on the accused to prove innocence in the courts


When an FIR under IPC section 498A (498a) is registered, the accused are automatically arrested and jailed without investigation. The Supreme Court of India has ruled several times that arrest should be an exception, and not a compulsory. Why is there no penalty for disobeying the Supreme Court’s orders? Is it not mental cruelty to subject a person to arrest without investigation or reasonable cause?

We are not talking about the dowry deaths or physical injury cases but about dowry harassment cases that require no evidence and can be filed just based on a single word, complaint by the wife. With an estimated 50,000 such accusations per year and an average of 3 members of the husband’s family implicated in each of these 498a cases, about 150,000 people are directly affected by these false accusations

The controversial section not only covers dowry, but a wide spectrum of incidents including cruelty, causing injury and danger to mental or physical health.

as on June 30 2005 are those under sections 498 and 498(A). In the first six months this year, 3801 new cases under just these two sections were instituted.


Thanks to the awareness levels among women, many more are approaching the courts today than before. Consider this against the number of cases that are disposed. They are only 2432 cases. Of them, only 164 cases led to convictions. 1449 cases ended in acquittal with the aggrieved women considering further appeals.

This poorly formulated law is inviting unscrupulous women to file false cases, and causing the imprisonment of innocent husband and his Family without investigation. These innocent people undergo stigmatization and hardship even before a trial in the court of law which leads to emotional, physical and financial burdon. Some of the falsely accused have committed suicide after being jailed, unable to bear the social consequences.

As per Recent Report From Ahmedabad, Rajesh hasmukh Desai commited suicide, He was charged with 498A Falsly.If a women dies in any circumtenses, Authority by default Police will arrest man, but in this case police did not took any action nor they questioned his wife, nor took any action.

Despite the recommendations of the Supreme Court of India and Justice Malimath Committee that the legislative arm should modify the laws such that the innocent are protected, the suggested amendment to the law has been largely ignored. Unconstrained, this social evil is threating the foundaton of the Indian Family system.


Why do people misuse IPC 498a?


Legal Extortion – When marriage is on the brink of Divorce, she find no other weapon to harass husband than 498A


Pre/extra marital Affairs – She marries to satisfy her parents, without disclosing her fast,when husband find out she has no option than file dowry case to blackmail him,same applies to extra marital affairs too.


Domination – Wife wants the husband to abandon his parents and siblings, and have total control over his finances and social behavior, including his life-style


Custody - Deny the father and his family access to their child(ren).


Fraudulent Marriages - Many time girls family will not disclose actual facts of thier daughter,that leads to divorce,then legal extortion follows.


In-Laws - When modern women is unable to adjust with her In Laws, to dominate her husband and make him dance as she says she goes for dowry case.



Consider a person who works extremely hard to make his career. Then he marry a wolf who drags him to court. There he is bound to loose all dignity, children custody and above all 50% of his income. He is forced out of family, money and all. Using his money all along wolf teaches to the child that father was bad. Despite feeding the child on Fathers' money. He has nothing to look at when he grows old. And Indian judicial system is just not meant for any justice.


This is nothing but sure cruelty. Extreme disastor. And unending mental trauma. Apart from this I've seen men bieng ditched by various girls before marriage. In cities it is common that girl have many boyfriends. And they choose the richest among them for marriage. Rest are ditched. And few eaker among them commit suicide. Says Amit Agarwal a Victim of 498A.


Nearly five crore married women in India are victims of domestic violence (DV). Only 0.1 percent (1 out of 1000 DV cases) of these are being reported. Out of 100 cases that are ordered for investigation under 498A, only in 2 cases the accused get convicted.


‘‘People generally use this law to facilitate a divorce. And often, it’s the lawyers who advise the women to implicate their in-laws under the provisions of this Act,’’ says Shantosh Singh, chairperson of Women Welfare Counseling Cell. Often, the number of items given in dowry is inflated to claim a high settlement amount. “There are only 10 per cent cases based on truth, and people usually come to us and ask specifically to mention the element of dowry in their divorce petitions,” says Amrikh Singh Kalra, advocate at Punjab and Haryana High Court.


Women mis(using) laws to get even ?
NEW DELHI, Oct 18 (PTI) —Laws against violence at home may or may not have come to the rescue of battered women, but some of them have been accused of abusing them to get an easy divorce or settle other little domestic disputes.

According to the available statistical information from the National Crime Records Bureau and information available from NGOs working with victims of violence, there is a general tendency to avoid seeking redressal among the victims of domestic violence. However, when a victim of domestic violence seeks help from any of the agencies, be it family, friends, NGOs, or lawyers, before registering a complaint, at each stage she is asked to reconcile the matter or to put up with the situation. Reconciliation in 498A cases takes place at every stage including the police station, Crime Against Women Cells and courts.


We found that in five cases filed under Section 498A the parties settled the matter after agreeing on maintenance and divorce.


In a majority of the cases before a victim filed the complaint under Section 498A, the minimum period she suffered physical and mental torture, was for about three years.


The trial process is quite lengthy and the proportion of pending cases is quiet high (out of the 40 cases based on victims' interviews which went for trial in court, 28 cases are still pending). In the cases tracked, the normal trial period was between five to ten years.


" It was found that it was difficult to prove physical and mental torture. In all the eight cases in which the accused were acquitted, the victims were found to have suffered physical and mental torture, but as there was not enough evidence to prove torture, the accused were let off.


The cases where the accused were convicted had been filed under Section 498A along with section 304B and 302, which are applicable after the death of the victim. There were no convictions in any of the cases registered only under Section 498A.


It has been found that out of 30 cases there is not a single case where the accused has been convicted only under Section 498A. The accused have been acquitted (11 cases) by the court where the prosecutor failed to provide evidentiary proof of cruelty, mainly mental, inflicted on the victim as provided under Section 498A IPC.


The judicial authorities of India, in number of landmark judgments, have taken a serious view of the growing tendency to falsely implicate innocent members of the husband’s family in dowry cases. Describing misuse of IPC-498a law as “legal terrorism”, the Supreme Court said no one could be allowed to unleash frivolous proceedings on this count as the provisions of Section 498a “is intended to be used a shield not as an assassin’s weapon.”


“The stringent dowry laws, meant to deter dowry-seekers, are being increasingly misused by the very people they are meant to protect. The last three years have seen a steep rise in the number of cases of harassment for dowry”.

There are many heart-rending stories of innocent families being arrested without investigation and put in judicial custody. While IPC 498a is supposed to be a law to protect women, ironically it harms many more women. For every male accused of IPC 498a, there is at least one woman (his mother or sister) who is implicated in a crime that never occurred or they never stayed together. If there are more women in the family they too are accused irrespective of their age, health condition, marital status or their physical proximity to the complainant. There are many Reports, married sisters of husband,even they are pregnent or with small baby in hands are jailed without any investigations.or The entire family is ruthlessly arrested without investigation and there are no words to describe the financial hardship and emotional trauma that they have to endure. Children suffer whether they are jailed along with their mothers or are separated from them during that time.
